04: Responsibilities of the trustees

The main duties of the trustees are the same for both incorporated and unincorporated charities, and include:

  • Ultimate responsibility for directing the affairs of the charity, ensuring it is solvent, well run and delivering against the charitable aims and objectives for which it was set up.
  • Ensuring that the charity complies with charity law, with the requirements of the regulator – the Charity Commission – and with any other laws and regulations that may apply.
  • Ensuring that the charity prepares reports on what it has achieved and an annual report and accounts (as required by law).
  • Acting with integrity, and avoiding any personal conflicts of interest or misuse of charity funds or assets.
  • Ensuring funds and assets are only used to further the charity’s objectives.
